The process of making a Surety Bond claim can sometimes be unnecessarily demanding on cost, resource and time.

Surety Providers and their representatives can be difficult to work with in regard to the settlement and agreement of a bond claim, irrespective of its validity. To mitigate such an issue, the Surety Bonds National Council makes the following recommendations:

  • The diligent assessment and vetting of any proposed Bondsman for use, ensuring they have a positive Claims History and Claims Protocol.

  • The use of an overseas Bond Provider should be approached with caution. Clarification in relation to the provision of Surety Services under UK Jurisdiction should be requested.

  • Irrespective of the location of the Underlying Contract and Works, bonds should be construed and governed by the laws and jurisdiction of England and Wales to ensure maximum protection.

  • The appointment of a specialist Claims Management Company to work on your behalf regarding any Bond Claims.
